Terms and Conditions
King of Contractors is a service of MGK Pools Inc, 28 Front St, Winchendon, MA 01475. Phone: (978) 850-5464. By using this website or our services, you agree to these terms.
Our Service
King of Contractors provides AI-powered phone answering, missed-call text-back, lead capture, and related communication services for contractor businesses. Our services are for business customers only — not consumers. Service plans, features, and pricing are described in your service agreement. Plans are billed monthly and may be canceled with thirty days notice as described in your agreement.
Callers to lines we answer may be greeted by an artificial-intelligence voice assistant; our assistant identifies itself as an assistant when asked. Our services depend on third-party providers — telephone carriers, text-messaging networks, AI and hosting vendors — and we are not responsible for outages in those third-party networks.
SMS/Text Messaging Terms
King of Contractors sends text messages only to people who have opted in to receive them. Opting in is always optional and is never a condition of purchase or service. Message types include responses to your inquiry (such as information you requested), callback and appointment confirmations, and appointment reminders.
- Message frequency varies
- Message and data rates may apply
- Reply STOP at any time to cancel; reply HELP for help or call (978) 850-5464
- Carriers are not liable for delayed or undelivered messages
- See our Privacy Policy for how phone numbers are handled - mobile opt-in data is never shared with third parties for marketing
Do-Not-Call Policy
We respect the right not to be contacted:
- Suppression list. Anyone who asks not to be contacted is added to a platform-wide do-not-contact list. Our services will not text or place outbound calls to suppressed numbers on behalf of that client.
- Opt-out keywords. All texting honors STOP and UNSUBSCRIBE (immediate opt-out with one confirmation message) and HELP, as described in the messaging terms above.
- We respond; we don't solicit. Our services primarily respond to calls and texts that a client's own customers initiate — such as texting back a missed call. These responses are not telemarketing.
- Client and representative responsibility. Any outbound cold calling or cold texting performed by a client or a sales representative is their own act, and they are solely responsible for compliance with the TCPA, the National Do Not Call Registry, and state telemarketing laws. We do not scrub third-party calling lists, and use of our services for cold outbound campaigns to purchased lists is prohibited.
- Removal requests. Call or text (978) 850-5464 or email mike@kingofcontractors.com.
AI-Answered Calls, Recording & Transcription
Calls handled by our services may be answered by an AI assistant and may be recorded and transcribed for accuracy, quality, and to deliver the service — transcripts, lead alerts, and activity reports. Clients authorize recording on lines we answer for them, and are responsible for any caller-notification requirement that applies in their own state. Massachusetts requires all-party consent to recording; our assistant includes a recording notice where configured.
No Guarantee of Results
We work hard to capture every call, but no answering system is perfect. Except for an express guarantee stated in a signed service agreement, we make no promise of leads, revenue, call volume, or business results. Testimonials and reports describe individual results, not promises.
Limitation of Liability
Our services are provided as-is. Our total liability for any claim is limited to the fees you paid us in the three months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages — including lost profits, lost business, or calls and leads missed during an outage.
Your Data
Clients own their customer data — contacts, call logs, and transcripts. On termination, a client may request an export of their data within thirty days; after that we may delete it. We use client data only to deliver our services and never sell it. See our Privacy Policy for how personal information is handled.
Acceptable Use
Our services may not be used for unlawful, deceptive, or harassing purposes, for cold-list robocalling or robotexting, or resold without a signed representative agreement. We may suspend service, with notice, for abuse, non-payment, or carrier-compliance risk.
Billing & Cancellation
Setup fees are due at signing. Subscriptions bill monthly on the installation anniversary. If your plan includes a money-back guarantee, the guarantee wins: any refund it promises — including our 110% guarantee where offered — covers everything you paid under its terms, setup fee included. Where a plan includes the 30-day guarantee: you may cancel at or before your day-30 review for any reason and receive 100% of everything you paid back; the 110% refund applies when your receipts report does not show the service captured more value than it cost — the extra 10% is our penalty for failing to prove our value, and does not apply where the receipts prove the value and you cancel anyway. Outside a guarantee, setup fees are non-refundable once installation starts. Money-back guarantees are limited to one claim per business and its owners, require the conditions stated in your agreement to be met, and pay to the original payment method; fraudulent or abusive claims void the guarantee. If a payment fails, we retry and notify you; continued non-payment pauses service as described in your agreement. You may cancel at any time, effective at the end of the paid month — there is no long-term contract.
Disputes & Governing Law
These terms are governed by the laws of Massachusetts, without regard to conflict of law principles. Before any formal action, both sides agree to attempt good-faith resolution for thirty days after written notice of a dispute. Any action is brought in the courts of Massachusetts.
Changes to These Terms
We may update these terms. Active clients are notified of material changes by email or text at least fourteen days before they take effect. Continued use of the services after that date is acceptance of the updated terms.
